Federal court upholds congressional subpoenas for Donald Trump's Deutsche Bank records

A federal appeals court ruled Tuesday that banking institutions must comply with a House Democrat-issued subpoena for President Donald Trump's financial records.

Soon after, an entirely different federal appeals court also ruled against Team Trump in a case dealing with a U.S. House subpoena of Trump's accounting firm, Mazars USA, for the president's tax returns. Trump is expected to appeal the case to the US Supreme Court.

"Congressional oversight has deep roots in our nation's legal and political tradition, and the House subpoenas at issue in this case fall well within Congress's broad oversight authority", Corod said in a statement.

The material sought by the committees include records of accounts, transactions and investments linked to Trump, his three oldest children, their immediate family members and several Trump Organization entities.

"The Committees' interests in pursuing their constitutional legislative function is a far more significant public interest than whatever public interest inheres in avoiding the risk of a Chief Executive's distraction arising from disclosure of documents reflecting his private financial transactions", the judges wrote.

Trump most recently asked the US Supreme Court to hear arguments over whether or not Manhattan District Attorney Cy Vance could enforce subpoenas seeking similar documents as part of a grand jury probe. They argue that Trump can not be prosecuted or even investigated for crimes while he's president.

The appeals court was reviewing a district court decision from May that cleared the way for the House subpoenas.

A 2017 disclosure form showed that Trump had at least $130 million of liabilities to the bank.

"We have recognized that this loss of privacy is irreparable", the court said.

Capital One did not immediately respond to a request for comment.

Two Democratic-controlled committees issued subpoenas to Deutsche Bank and Capital One in April demanding that they hand over financial records related to Trump and his family. She called the subpoenas "deeply troubling" because they make no distinction between business and personal matters and seek information about the president's wife, children and grandchildren. If tax returns of Trump himself were held by the bank, then the information might be legally held back, but the bank said on August 27 the returns it has don't include the president's. It also gave litigants a limited chance to object to disclosure of certain documents. Newman is a nominee of Jimmy Carter.

Two of the appellate judges signed onto the opinion - while one other judge concurred in part and dissented in part. Newman was joined in the ruling by Judge Peter Hall, a Bush appointee.
